Terms of service

These terms apply when you use the Clay&castle website and buy from us. Clay&castle is a New Zealand business located at 276 Maungaraki Road, Lower Hutt 5010, New Zealand.

1. Using our store

  • You must be at least 18 years old, or have the permission of a parent or guardian, to place an order.
  • You agree to provide accurate and complete information when ordering and to keep your account details secure.
  • You may not use the site for any unlawful purpose or in any way that could damage or interfere with it.

2. Products and descriptions We try to describe and photograph our products accurately. Colours, finishes and sizes may differ slightly from what you see on screen. We may update product information and discontinue products at any time.

3. Prices and currency

  • Prices are shown in New Zealand dollars (NZD) for customers in New Zealand and Australian dollars (AUD) for customers in Australia.

  • The total shown at checkout is the amount you pay, including any delivery charge. Delivery charges are set out in our Shipping Policy. For New Zealand orders over NZ$1,000, import charges may apply as explained in our Shipping Policy.

  • Prices may change at any time, but changes will not affect orders already accepted.
  • If a price is clearly listed in error, we may cancel the order and give you a full refund.

4. Orders and payment

  • Placing an order is an offer to buy. We may decline an order, for example because of stock availability, a pricing error or suspected fraud. If we decline an order after payment, we will refund you in full.
  • Payment is taken when you place your order using the methods offered at checkout. Payments are processed by secure third-party providers and we do not store your full card details.

5. Shipping and delivery We ship to New Zealand and Australia. Delivery times are estimates. Many items ship directly from our suppliers in Australia, so orders with several items may arrive separately. Risk in the goods passes to you on delivery. See our Shipping Policy for details.

6. Returns, refunds and your consumer rights Returns and refunds are handled under our Refund Policy, which forms part of these Terms. If you are buying as a consumer, you have rights under the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986, or the Australian Consumer Law, that cannot be excluded. Nothing in these Terms limits those rights.

7. Product use and safety Please follow the manufacturer's instructions, warnings and safety information that come with each product, including for electrical items, lights and inflatables. Do not use a product that is damaged or has missing parts.

8. Intellectual property All content on this site, including text, images, graphics and logos, belongs to us or our licensors and is protected by copyright. You may not copy or use it for commercial purposes without our written permission.

9. Third-party links and services Our site may link to third-party websites or use third-party services. We are not responsible for their content, policies or practices.

10. Limitation of liability To the extent permitted by law, Clay&castle is not liable for any indirect or consequential loss arising from your use of the site. This does not limit or exclude any guarantee, right or remedy you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Australian Consumer Law or any other law that cannot be excluded.

11. Privacy Our Privacy Policy explains how we collect, use and share your personal information.

12. Changes to these terms We may update these Terms from time to time. The version on this page when you place your order applies to that order.

13. Governing law These Terms are governed by the laws of New Zealand. This does not take away any rights you have under the consumer laws of the country where you live.
